August 29, 2020 is the 30th anniversary of the signing into law of the Companies (Amendment) Act 1990 by President Patrick Hillery. The Act, which had been rushed through emergency sessions of the Houses of the Oireachtas earlier in the week, provided for a system of court protection for businesses in financial difficulty, similar to the US Chapter 11 procedure, and for the appointment of an examiner to examine whether a company, and the whole or part of its business, could survive as a going concern.
